TERMS and conditions

1. Services:

Plutoniq Fitness offers personal training and group fitness classes, as well as performance nutrition services. By engaging in these services, clients acknowledge that they are in good physical condition and do not have any medical conditions that would prevent them from engaging in exercise.


2. Payments and Cancellations:

Payments for personal training sessions and group fitness classes must be made in advance. Clients will be charged for sessions that are cancelled with less than 24 hours notice.


3. Liability:

Plutoniq Fitness will not be held liable for any injuries sustained while participating in our services. Clients engage in our services at their own risk and are responsible for informing their trainer of any medical conditions or injuries.


4. Refunds:

Refunds will not be given for any services that have been provided by Plutoniq Fitness.


5. Privacy:

Plutoniq Fitness respects the privacy of our clients. Any personal information provided to us will be kept confidential and will not be shared with any third parties.


6. Health Disclaimer:

The information provided by Plutoniq Fitness is for general informational purposes only and is not intended to be a substitute for professional medical advice, diagnosis or treatment.


7. Changes to Terms:

Plutoniq Fitness reserves the right to make changes to these terms and conditions at any time. It is the client’s responsibility to review these terms and conditions regularly.


8. Age Restrictions:

Participants in Plutoniq Fitness’s services must be at least 16 years of age. Minors may participate with written consent from a parent or guardian.


9. Photo/Video Release:

By participating in Plutoniq Fitness’s services, clients give permission for Plutoniq Fitness to use photographs or video footage of them for marketing and promotional purposes.


10. Online Services:

If Plutoniq Fitness offers online services such as virtual training or nutrition consultations, clients understand that the quality and availability of these services may be affected by their internet connection and equipment. Plutoniq Fitness will not be held liable for any issues related to online services.


11. Medical Clearance:

Clients are required to provide written medical clearance from a physician prior to engaging in any of the services offered by Plutoniq Fitness.


12. Indemnification:

Clients agree to indemnify and hold harmless Plutoniq Fitness, its owners, employees, and agents from any claims, damages, or expenses arising out of their participation in our services.


13. Governing Law:

These terms and conditions shall be governed and construed in accordance with the laws of the state/province in which Plutoniq Fitness is located.


14. Non-Transferable:

Services provided by Plutoniq Fitness are non-transferable and may only be used by the client who purchased them.


15. Consultations:

Plutoniq Fitness offers free consultations for new clients to discuss the services and packages that may be best suited for their fitness goals and needs.


16. No Obligation:

The consultation is offered with no obligation for clients to purchase any services or packages from Plutoniq Fitness.


17. Information Sharing:

Clients understand that during the consultation, they may be asked to provide information about their medical history and fitness goals. This information will be kept confidential and will be used to provide personalized recommendations for services and packages.


18. Pricing:

Clients will be informed of the pricing for any services or packages that are recommended during the consultation. Pricing for services and packages is subject to change and may be different than the prices listed on Plutoniq Fitness’s website and printed materials.


19. Cancellations:

Clients must provide at least 24 hours notice if they need to cancel or reschedule their consultation and classes.


20. Liability:

Plutoniq Fitness will not be held liable for any injuries or damages that may occur during the consultation. Clients engage in the consultation at their own risk.

21. Equipment:

Clients are responsible for providing their own equipment and clothing suitable for the training and Plutoniq Fitness will not be held liable for any injuries or damages that may occur as a result of the use of the client’s equipment.

22. Training Location:

Clients understand that the training sessions may take place at Plutoniq Fitness’s facility, or outside location and even online as per the convenience and availability of the trainer and client .

24. Trainer Substitution:

Plutoniq Fitness reserves the right to substitute the trainer assigned to the client if the original trainer is unavailable.

25. Progress Tracking:

Clients understand that Plutoniq Fitness will track their progress throughout the course of their training and may share this information with them.

26. Compliance:

Clients understand that they are expected to comply with all safety instructions and guidelines provided by the trainer during their training sessions.

27. Class Capacity (Group classes):

Each class has a limited capacity, clients are required to register for the class in advance and understand that class may be full and not able to participate.

28. Services:

Plutoniq Fitness offers performance nutrition consultation services to clients looking to improve their nutrition for optimal athletic performance or general health and wellness.

29. Liability (nutrition):

Plutoniq Fitness will not be held liable for any adverse reactions or health issues that may occur as a result of following the nutrition plan recommended during the consultation. Clients engage in our services at their own risk and are responsible for informing the consultant of any medical conditions or allergies.

30. Information Sharing (diet consultation):

Clients understand that during the consultation, they may be asked to provide information about their medical history, current dietary habits, and fitness goals. This information will be kept confidential and will be used to provide personalized recommendations for their nutrition plan.

31. Follow-up Consultations:

Clients may schedule follow-up consultations to review their progress and make adjustments to their nutrition plan as needed. Additional charges may apply for these consultations.

32. Meal Plan:

Clients understand that the nutrition plan recommended during the consultation may include a meal plan and they are responsible for purchasing and preparing the food items on the plan.

33. Supplements:

Clients understand that the nutrition plan may recommend the use of supplements, and they are responsible for purchasing and taking the supplements as directed.

34. Non-Disclosure (injury management):

The client agrees not to disclose any information provided during the consultation without the prior written consent of Plutoniq Fitness.

35. Services (injury management):

Plutoniq Fitness offers strength training services for clients who have been injured and have undergone medical treatment and physiotherapy. These services are provided by personal trainers who have additional certification in working with special populations.

36. Medical Clearance for injured clients:

Clients are required to provide a written “No Objection Certificate” from their doctor or physiotherapist before engaging in any strength training services offered by Plutoniq Fitness.

37. Liability (injury management):

Plutoniq Fitness will not be held liable for any injuries sustained while participating in our strength training services. Clients engage in our services at their own risk and are responsible for informing their trainer of any medical conditions or injuries.

38. Compliance:

Clients understand that they are expected to comply with all guidelines and recommendations provided by the trainer during their strength training sessions.

39. Communication (injury management):

Clients agree to communicate with their trainer about any concerns, questions or changes in their condition, during the course of their strength training.

40. Return to Activity (injury management):

Clients understand that returning to normal activity will be a gradual process, and that it is important to follow the guidelines provided by their trainer.

42. Follow-up Appointments (injury management):

Clients may be scheduled for follow-up appointments to assess their progress and make adjustments to their strength training plan as needed.

43. Pre-exercise Screening (injury management):

Clients agree to complete a pre-exercise screening questionnaire before starting strength training.

44. Safety Guidelines:

Clients agree to follow safety guidelines and instructions provided by the trainer during their strength training sessions.

45. Waiver of Liability:

Clients understand that engaging in strength training after an injury carries some risk, and that they are required to sign a waiver of liability before beginning their strength training sessions. This waiver will release Plutoniq Fitness, its owners, employees, and agents from any liability for any injuries sustained while participating in our strength training services.
